      It does not make sense. The LL is the one who cannot give the 2 months' notice because she terminated her own rights of rental with HDB. So she has to pay the tenant damages for early cessation of contract or find a new place for them since she is an agent. Her act of termination of her unit with HDB for rental is VERY FISHY.

          Assuming that the tenant able to return a reasonably good condition unit back to LL..the tenant should get back 2 mths unserved notice, 3 mths deposits, reimbursement of lawyer fee incurred plus tenant's transportation/time and possibly anguish caused..if only we have the power to do that 😉

            Perhaps what we need to know is… if LL has given notice or not. As it sounds like notice was given but tenants refused to leave. As so, after 2 months (or more) is up, at wits end, the LL went to terminate the approval so to evict the tenant on the basis of overstaying. Calling police to help, sounds very very very desperate for a contract that ends in 8 months. Are we certain that the tenants have no fault?


            Disclaimer: I don’t know this agent/LL… and have no intentions of siding anyone. Just providing a possible scenario.

              Check with LL or tenant when was the notice given to vacate? Did tenant do anything out of line? I’m struggling to understand why with only 8 months left, LL would violate the contractual terms.

              I hope the tenants found a new home and is settle down well there. Put the past behind and start afresh. If they need any appliances, I have some pretty new ones to give away.

                  That is correct. If LL is found errant in this whole deal, she has to pay that.

                    HDB replied to the tenant’s lawyer that they have no sight of the TA and they are not responsible for it. Any TA dispute between tenant and LL has nothing to do with HDB.

                    HDB can terminate the approval to rent out the unit upon LL’s request.

                      what is the purpose of hdb's role in renting out a room or flat besides collecting a fee for each transaction?

                        One possible reason, could be a red hot HDB rental market. The rental for the unit was 40% higher today than the rental agreed 2yrs 04mths ago. The monthly difference is about $1,500 which is very significant.

                        The termination letter from HDB was supposed to serve as a notice to vacate with immediate effect.
