I think some compensation can be made if one is wrongly sentenced to jail. I remember there was a case involving two brothers, whereby one subsequently was acquitted after serving some time in jail. IIRC, the state offered some compensation.

For fine, so far never heard of anyone who is wrongly fined.

Yes, like what you say, death penalty is one that is non-reversible and thus, need to be more prudent. It is thus not surprising that all cases punishable by death, have to be trial in HIgh Court and if I am not wrong, even the accused person wants to plead guilty to a murder charge, he cannot do so.

Prosecution still have to provide the evidence to prove beyond reasonable doubt that the person is indeed the murderer. So meaning, if there is no other evidence, apart from the accused admitting to it, likely he will be discharged not amounting to acquittal too.

If there were enough to convict, undoubtedly, the court would have done so. The burden of proof in a homicide is on the prosecution, and just perhaps, in this case, there was not enough to clear that bar.

Why don't you stop her?

You are a man, surely you can overpower her and grab the knife?

Why are you there in the first place?
We were horny.
There are many chances to stop her, why didn't you?

It wasn't that she threatened to jump from the building, when she climbed into the tank, he could have grabbed her etc.
Definitely doubtful testimony but when there's no concrete evidence even you know that's the man right in front of you also cannot do anything. Surprisingly that prosecution didn't raise such questions which should easily overturn his testimony. Maybe his defense lawyer better than the prosecution. This could be the case as it's battle between the wits. :siam:

Yes, it is significant that he was not acquitted but just discharge due to insufficient evidence.
