<![CDATA[Home leave for breaking conrtact]]>Hi, would like to know is paid home leave compulsary for them?


My maid been with me for the 5th year, her contract supposed to expire next May. After last contract she went back for 23 days home leave and I paid her fully. Now she want to break the contract as she had found an ang mo employer but only come in July, she said she willing to pay me for breaking contract. As far i understand home leave is for next contract cos if she finished her contract i just need to send her back without any leave, I listed down that she should pay me back the home leave money which she did not work yet get paid, insurance, renewal fee and the owwa paper fees. Thought of paying half for her but will wait till end July then tell her, idiot her told me this morning that she wan go MOM check whether she should pay all these anot, I m damn angry, what do u all think, i m so worked up that i have thought of cancel her permit and send her home, that it.

For me, I would want to keep something in SG in case she backs out. But I am open to paying for remittance fees on that deposit when she comes back. I would feel she doesn’t want to come back if she doesn’t have anything to look forward to.

I will definitelt scout around for a new maid during her home leave.....just in case.

My 1st maid - a motherly lady kept her word and back everytime she went on home leave and she did not even leave any deposit with me.

2nd maid - promised to come back but sms on the day of arrival that she won't be coming back. did not leave any deposit with me. later i learnt she borrowed from my MIL $10 and other maids ranging from$10 -50.

3rd maid - said got to go on home leave to divorce her husband who abandoned her 10 year old child. wanted to come back after home leave but not keen to put deposit. later i returned a missed call which was her sister's and found out that her child had been taken care of by her sister and that maid had no outstanding issue with her husband!

Present maid- good wants to come back after home leave, voluntarily offerred to keep a deposit with me, but recently asked me whether she can take her deposit with her!

@carebear - can I suggest that you voice your frustrations to the Indonesian embassy? If all employers take the same stance, the maids are going to suffer. Some of them take a year to pay off their loan which makes it very unfair if they are then sent home with no option to renew even if they want to.

I have previously called and emailed them many times regarding the KTKLN issue.
Calls and emails were not answered.

My present maid is very good and she wants to work after her home leave.
I have done my part and it is up to her to do her part (get KTKLN card).

I have spent slightly more tha $600 for her return ticket, insurance and passport renewal, not to mention days off from work (i am a daily rated worker and hence have no pay when i don't work).

Sometimes due to ignorance, procrastination (leading to failure to obtain the card), lack of money etc, she may not be able to return even if she wants to.

I am crossing my fingers and praying hard that she will return.

My contract with maid says that she is given home leave only if she signs another 2 more years of contract.

If you are not renewing her after two years , then there is no need for you to give her any home leave, you just need to pay for her ticket home. But if she can find an employer and you are willing to transfer her, then I suppose you can give her the money for air ticket (if she is not going home before she starts with her new employer.

Now that I find the situation rather dicey cos of the KTKLN issue, I am worried that she might not be able to return to work for me.

I have decided that for future maids, there will not be home leave, and if they want to return home, I will not renew the contract.

If she finds someone before the end of the contract and you are willing to release her and she doesn’t want to take leave before moving to the new employer, then you could give her a bonus as compensation. If she does want to go back then you could pay for her ticket instead. As for the paid leave, maybe again just give her a bonus for spending money.

I have the same problem here, I had just renewed my maid contract for another 2yr, she went home and came back, worked for 4 months and now said that she wanted to go home.

I would like to check with you what is the entitlement of the claim? Can we ask her to pay back half the insurance that we had brought for her new contract? Do we have to pay for her flight home this round?

Would like to hear from other who has encounted such problem as well...

You should be able to get a refund on the unused portion of the insurance - you will lose out slightly but you should get most of it back.

Is maid expected to pay for the breach in contract?

My grandma’s maid went back on home leave even though her 2 years contract with us is not up (1 year only), and she met some problems with custom (no KTKLN and no money to apply for card) and thus couldnt come back. But the case now seems to be, she doesnt want to come back even though her contract with us is still in place.

Key question is… Is she expected to pay for the breach in contract?

We have never had such problems and this is the second maid we hired for my grandma. Agency is not very helpful as for everything, they would ask us to refer to embassy. The KTKLN fix is also indirectly due to agency’s ill-informed information (they seemed clueless about KTKLN)

no penalty on the maid. As far as I remember, as long as either side want to terminate contract, employer will have to pay for the flight back - and can get nothing back.

You may tell her straight that you have the right not to sign on the transfer letter. You can just send her back straight. Ask her feel free to CHECK with MOM. It is out of goodwill that you are willing to let her go straight to the new employer without occurring more agency fees to come over. She is the one who want to break the contract, yet she dare to demand from you?


You may want to call MOM to check whether what type of money you can get back from the maid. Eg. homeleave etc I believe they can give you a better answer. It better to go thru a proper / legal procedure than getting all the trouble from her later.

Since she had worked for you more than 5 years. Do you want consider the 5 years relationship which she had with you and close 1 eye?

After getting the same problem as you from my ex-maid, now all the new maid, I told them I will not sign on the transfer letter unless they worked for me till end of the contract. So either they go back or if they want to transfer no problem, end of the 2 years conract, I will sign on the transfer form.
