FCBC reached some sort of understanding with MOM and the judicial review application was dropped.

Don't think it was raised the first time round. This one you have to ask his lawyers.

Christian judges are not excluded merely because there is a Christian issue. They are excluded because the charge says that AY posted something that offended Christians as a class, of which the judge by definition is a member.

Take an example. You will recall that we disagreed some time ago over the FCBC case where the church terminated a pregnant woman's employment. One can say it involves a Christian issue, but that does not mean that the case (if it had proceeded) cannot be heard by a Christian judge. It does however mean that it cannot be heard by any judge who attends FCBC.

In the present case, if a Christian judge finds it offensive to his/her religion, there is a possibility of bias. But if the Christian judge personally does not find it offensive to his/her religion... ?! The rule is there to prevent this kind of no win situation.

Perhaps we should not forget that the Prosecution also does not appear to disagree with the request. At least there is no report that it does. Stop being so worked up by the media over something that even the Prosecution does not seem to care.

rains, if you have not been following AY's doing, then it is tough to pass views based on general logic. This guy defies logic in his behaviour. He can bite the hand of people who help him. In fact, he scripted his own movie knowing that some people like yourself will show compassion due to his age. Of course there are always people who have lower tolerance and expressed utter disgust in an ill manner themselves. That aside, we need to see the real issues posed by AY. As Nebbermind aptly puts it, ignoring him is the best way forward because he is driving his own story, he is asking for the attention. His latest is his appeal against his sentence of 4 weeks and asking for a non-Christian judge. 自导自演...and refuses to stop after he has been released...he is asking to go through the court process again.....

Did I for one second dispute that the appearance of impartiality is important? I am questioning the the application of that principle in the manner the AY's attorney's have done. Can one apply for an enitre class of judges, based on a demographic trait, wholesale, to be excluded?


Alright, Mr Member of the Bar, please clarify, that if I had a beef with and Indian neighbour in a dispute, can my lawyer reasonably apply that an Indian-race judge (not one judge, but a class of judges) not be assigned to the case. And if so, if it pleases you your honour, that you cite like cases and what reasons the courts allowed such an application to stand?
