      I bought my HDB flat in 2008 from open market. Ofcourse i'm allowed to buy private property, HDB rule says i must stay in my HDB house for minimum 3 years and The flat can't left empty, can't sublet. One option is i need to sell my HDB flat. but i don't want to do that.

      Just i bought a private property this month which is 1km near to school.
      but i can't move in because i must stay upto 2011 in HDB flat.
      but i want to use my new property address for my daughter P1 in registration 2010.
      is it legally possible.
      Hi!

      The Minimum Occupation Period is used to calculate your eligibility to sell or rent the flat. In your case, your MOP ends in July 2011. This means if you stay in your HDB flat for 3 years, the MOP ends in July 2011. You will be eligible to sell or rent your flat after July 2011.

      However, if you choose to stay in your private property, you can still do so. You will not be able to rent out your HDB flat, though, since you have not fulfilled the MOP. Where are you staying currently? Assuming you have stayed in your HDB flat since you bought it in 2008. Further assume that you plan to stay in the private property starting Jan 2010. By then, you will have stayed in your HDB flat for one and a half year. So, you are left with another one and a half year before you meet the MOP of three years. If you plan to stay in the private property for the full 6 years of your child's primary education, these 6 years do not count to the MOP.

      Your child starts P1 in 2011, and completes her primary education in 2016. Hence, assuming you move back to your HDB flat in Jan 2017. You will need to stay there for another one and a half year before you are LEGALLY allowed to rent or sell your HDB flat.

      That is the MOP. The Jul 2011 is a guide to let you know that, should you be staying in the HDB flat 100% of the time, the MOP ends then. However, if you do not sty in the HDB flat, the period that you are not staying there do not count towards calculating the MOP.

      Hope the above clarifies.

      As what jedamum mentioned, HDB flats are meant to be lived in. You need to have valid reasons why you are not staying in the HDB flat. I don't think HDB will accept reasons such as P1 registration.

      Like what the other forummers mentioned, check with HDB.

        Correct me if I’m wrong but I think the Minimum Occupation Period (MOP) is just a guideline. Don’t think the authorities will enforce on it.


        For my case, I’ve bought a new flat and sold it off upon reaching 5 fives. Question: Did I stay there during this period? Yes…but less than a month in those 5 years. You just need to write to them for confirmation so as not to disrupt your sales process.

          So, what was the address indicated in your NRIC during the 5 years that you owned but not staying in the flat?

                Agree...the authorities are aware of it. For my case, I wrote to them confirming that I've not not breached the \"rule\" as I do not want to jeopardise my sales.

                  thanks for your replies.

                  I checked the HDB website, it clearly stated that if i bought the HDB house in a open market then i must physically stay minimum 3 years before i rent out.
                  Some more i can’t leave the house unoccupied (i.e. leave the house empty and stay in other property) and can’t get my relative / fried to occupy without collecting rent.

                    I know this has been discussed and talked about many times. Though it’s an unfair way but we also know that there are actually alot of parents out there who used this method to get a place in desired school. I suppose if they’ve the resources to do it, no one can actually stop them.

                    Has anyone tried renting a place near a desired school and then use it for P1 registration?

                    How long must one rent the house before and after P1??? We’ve heard of all the "go by the book" etc… but one wonder if the authority will actually check that or have the resources to do it.

                    Also, I suppose there will probably be a need to rent the entire unit rather than a room.

                    What about supporting documents during P1 registration? Eg. someone rent a place (eg. room or unit), changes IC address to that address) then applies for P1. In this case, I don’t think the school will ask to see the rental agreement?

                      Hi, tagging on this topic, I would like to clarify something... I heard from some of my friends that there is a minimum period time that we need to stay in the vicinity near the school inorder to qualify for phase 2C. Is it true? They said that it is a minimum of 2 years before the actual registration to primary one.

                      If it is, then i need to move by next year...
