He was diagnosed as Asperger's, so presumably his condition is not so marked. I know a man of 50yo who is clearly Asperger's but has not been diagnosed. He got through school and university and even NS and work, although his lack of social skills have made things a bit tough for him. He only realised he was Asperger's when his daughter was diagnosed a few years ago, although some of us who have known him a long time could recognise it. My own daughter was not diagnosed until 14yo, and that was because we chose to send her for diagnosis for school/exam reasons. If not, I think she would have still managed to get through life, although with more difficulty.
For this young man, it's a pity that he was not able to control himself. What he did was clearly wrong even if it was due to a disability, and I think the penalty of making him go for treatment is the right thing for him. -

It's not a matter of age, but with time and teaching, they can learn more social skills. Many ASD kids learn social skills by instruction and practice, not as instinctively as NT kids. That's why we need to keep teaching them what is expected behaviour and what is not. After all that, they should improve as they get older. Without teaching and practice, just getting older makes no difference. For instance, with my daughter and her black/white right/wrong thinking, we have to constantly remind her that there is 'grey' in between the extremes, and help her understand how NT people think. We also have to keep telling her what is acceptable behaviour in different situations and eventually we should have covered enough that she can mostly cope OK. But we think she will always need understanding friends to help her when new things occur. -

Is it? From the iras website, looks like only physically handicapped and mentally handicapped (needing medication type, and severe type). -

It isn't. She's slow and he just kicked her. I think no matter what, asperger or autism is no excuse for poor behaviour. And from the way he explained himself, he isn't mentally challenged. He is just using that diagnosis to escape more severe punishment. -
