Well at least you still have that 1 mth deposit. Just go and check that everything is in order and if nothing major, use the deposit to cover the repairs. For all you know, the apt is in ok condition.
You mentioned that he is no longer employed since 1st April and that his passport has expired since Dec. He may be overstaying. And if he does not have an extended social visit pass, he is not the only one breaking the law but you are too.
Hi Funz,
My guess is that he may have come back as a tourist with visa or he has found a new job and has found a new place to stay. He informed my agent that he has shifted his stuff out already.
My agent has commented that the house was very messy during those times she brought prospective clients to view the apt.
I am keeping my fingers cross that the furniture/appliances/flooring are in ok condition. Not long after he first shifted in, my downstairs unit complained to security that he heard things being dragged around in the late night. He has a 2 year old child. If the flooring has been scratched, how to demand for compensation?
I fully sympathise with you and can understand your situation. My mum used to have an unreasonable tenant who spoilt lots of things that the house is in bad condition when moving out. Luckily she had the deposit to off-set and a good contractor to help mend up the things.
For flooring, there is nothing much that can be done. Just close one eye and rent out apt again - tenants normally don't scrutinise flooring unless very very badly scratched. If so, can consider using a rug / cheap carpet from Ikea to cover up. Continue renting out and till the day you are using the apt for yourself, can hack out everything and re-decorate.
For furnitures, usual wear and tear is normal. If can be used, can pass to next tenant, else get some cheaper furniture for next tenant. You can view thru' newspaper to get some reasonably priced furniture of reasonable quality. -

[/quote]Unfortunately nope - it is standard practice.
Good / bad tenant depends on how lucky you are. However, one can ensure protection through some standard clause in contract - eg. if have air-con, insist tenant must submit air-con service agreement with a company to do servicing quarterly (get agent to get this agreement from tenant right from start). -
actually when the tenant did not pay, you have the right to pad lock the house and keep the deposit unless the contract said so.
Also there is no need to do inspection at all.
Re-look into the contract…if no payment, what is your rights? If tenant did not pay for the 1 month, you have the right to take back your 1 month deposit. -

Laughingcat, I think what Dad8282 is saying is as the one month deposit is used to off-set the rent owed, there is no amount to further off-set should there be defects during inspection. Going by her agent's description of the messiness of the place, she is worried that there may be further defects which the tenants have clearly indicated he would not pay.actually when the tenant did not pay, you have the right to pad lock the house and keep the deposit unless the contract said so.

This tenant is obviously aware of the issues (maybe he has been thru' it before and last landlord deducted defects from his deposit) so he purposely use the deposit to off-set the last month rental! -
Tell the tenant you will make a police report and send it to his last employer, MOM, and ICA, cc your MP to give a bit of power. See if he scared. may not come to anything, but at least you will have done what you can.
If the damages are excessive, you may want to engage a lawyer. But with these foreigners, sorry, if they fly away, it’s pretty hard to enforce. I had an ex-colleague who racked up credit card bills and flew off - i knew becos my ex-boss then received calls from the cc company. -
Feel that this posting is impt. please read.
When you next rent out to pp, be careful. I know of pp either rent direct from owner and then sublet out to foreigners (becos the faces that appear at the door always change). And there are companies out there who rent from owners only to sublet rooms out to foreigners (usually short term). Imagine what wear and tear they inflict on your property, imagine if they rent it out to overstayers. you may not be found liable at the end for the overstayer, but I’m not sure if having to attend interviews etc is worth the trouble.
Be aware of what’s going on in the rental market, and esp what’s going on IN your property. -
hquek:
Ensure in your TA there is clause not to allow for sublet, and if renting to company, be clear to state occupant name and immediate family, and state clearly must be legal employment pass holders. Landlord has the right to conduct checks on property, and if found not in order, have the right to confiscate the deposit and order the company and occupant to vacate the property.Feel that this posting is impt. please read.

Nice in theory. But in practice, I’ve seen pp flout this with impunity.
Someone did just that but the tenant still sublet. He had to engage lawyer to throw out the tenant. Took time and money.
Another one even better. When the house owner found out, he demanded to see the tenant. Tenant was waiting in the house with a lawyer…and the lawyer asked the owner to stop harassing her client (tenant already cleared the other sub tenants just days before). -
For visits, best to make unannounced. I know of few cases where there was illegal subletting. Owner had to make appointment to check the house. Each time owner came, the house was all clean. Game was up only when the sub tenant went to management office saying she lived at room 3 of this house…it was a 2 bedroom unit hor.
