I hv serious reservations dat d District Judge is absolutely convinced himself when he cited “the intent of section 376B(1) of the Penal Code is to protect minors from being sexually exploited” in his oral judgement wrt to dis case.
If u concur dat dis underaged prostitution case is being played out to a larger, wider International audience wrt to human trafficking in minors, then whether d scales hv been tampered with by a shady fishmonger, d fish is fresh or smelly is not dat relevant, isn’t it? -

Most misguided interpretation of d law by a DPP – d deceitful prostitute who was not coerced/exploited into prostitution \"is ‘worthy’ of protection\" under d law.
The law states that the act of engaging the service of an underage prostitute is illegal. Those who committed the act will be dealt by the law bcoz they committed the ACT, not bcoz it is to seek redress or protection for the \"victim\".
Whether the prostitute is deceitful or not have no relevance. You can fight for contributory liability.. but you cannot be \"innocent\".
However, since it is already stated that \"reasonable mistake as to age\" is not a valid defense (read somewhere), there is no getting away regardless of whether the prostitute lied about her age or looked matured. -

An analogy. If salmon fish is going to extinct and there is an international ban of buying salmon less than 1kg in size. I go to the market and saw one salmon on sale. I asked the fishmonger and he assured me that the fish is more than 1kg. Looking at the size, it does look like 1kg.
I bought it and got caught. The officer weighed it and found it to be 995g and I am now faced with a fine. I told the officer that the fishmonger said it is above 1kg but he chided me for not asking the fishmonger to weigh it infront of me to confirm it is indeed above 1kg.

You could have exercised due diligence to verify by weighting.. but you didn't.
You took the gamble, the risk.
If unsure, walk away. .that is the message that the law is giving. -

In this case, you would be the innocent party, and I do agree that it is not fair to arrest you. Because you DID check the scale.
Let's relate it to the case. It is akin to the man asking to see the ID of the girl, and the girl produced an ID of someone older who looked almost exactly like her, or a fake ID so real that one could not reasonably expect it to be fake.
Then, the man will have a valid defense, IMO.
But, in all the man's case, no ONE actually verified the ID of the girl. That, is the key point. -

I see your point but I do feel that in this case, both the pimp and the underaged prostitute have made concerted effort to hide the real age. If nothing has been said and the guys took the risk, I would agree with you. However, iirc, the website had made a false representation that the girl is 18.

Just feel a little \"ai wan\" for these men. I do not think anyone of them has the intention of hiring an underage prostitute but because they failed to exercise due diligence, they are now facing the music.
