      Just relax:

      You have to be more precise in the 2 elements that you have mentioned.

      What the prosecution has to show is the following:
      1. That by an objective standard Tey, Ng Boon Gay and the SCDF chief had corruptly received gifts; and
      2. That the recipient had a corrupt intent.

      For the 1st element, the objective part of corruptly receiving the prosecution must prove and this is easy enough since all 3 men had affairs in the course of work which objectively would be considered corruptly receiving.

      For the 2nd element in the case of Ng Boon Gay and SCDF chief there is a presumption of a corrupt intent when a public servant receives a gift in the course of his work. Ng Boon Gay and SCDF chief have the burden of rebutting this presumption.

      That is why the Ng Boon Gay Defence has emphasized the relationship of Ng with Cecilia to show that Ng did not have a corrupt intent and that it was simply an affair. It will be the same Defence for the SCDF chief. Otherwise they should not be convicted for simply being unfaithful husbands.
      The potions in bold contradict themselves.

      The prosecution never have to show or prove that the recipient has a corrupted intent. This intent is automatically presumed to be corrupted once the recipient, being in a position of power and influence, received the gratification. It is then up to the defendant to prove otherwise - like what you have correctly pointed out that in his defense, NBG claimed that they are already in a relationship and therefore the sexual encounters arose from that and not from any corrupted intent as to rebut the presumption.

        This issue is still hogging the headlines.. Now Tey is still drawing $20,000 salary per month while on suspension. :evil:


        I still don't understand why Tey, a non-Singaporean can be our judge. Is he on EP? :rotflmao:

          i find it strange that he can still draw a salary while on suspension...why is he still paid?

            yea, why still pay him when he is suspended? is that why the tuition fees only increase and never decrease? i am sure there are other worthy lecturers who can take his place and teach.


            also, i find his actions in court very inappropriate for a former district judge.

              very inappropriate for a former district judge-suspended law professor to cook up so many cock and bull stories. he should have taught drama instead.

                  It is simply crazy that he is still getting paid!! NBG was suspended and drawing only half pay if I am not wrong. Why is this fella so special? NUS should really follow the civil service way of dealing with employees undergoing investigation and criminal proceedings.


                  As for the verdict? Not so fast. This fella will drag this to the fullest. Case is now a trial-within-trial as he is trying to convince the judge that all the statements he gave to CPIB were given under duress.

                    It’s plain obvious this fella is buying time…as such he should not be paid at all. Then he is not able to waste taxpayers’ money, judge & prosecutor’s time. All his crap and drama in the court.

                      The new paper reported today that prof Tey has a "long time" female friend who acted as defence witness for prof Tey. Despite lack of family ties, she managed to get confidential information about prof Tey from hospital. Then both of them were spotted together by TNP twice; once at the lobby of Tey’s home…
