      This statement just seems so wrong.... how can one be convicted of an offence w/o intent? it is generally understood that under common law, intent and act must both be fulfilled before someone can be convicted.

      Rather than say that \"there's no intent\", I believe, the actual law is \"intent is implied to be present, unless proved false\". i.e. burden of proof lies with defense, rather than prosecution as is the case for most offenses.

      may be that is why got difference between murder and manslaughter

      murder is premeditated, manslaughter is got intention to whack that fella siong siong (pak hor yi si) but never intended to kill, but he died from injury ....

        Section 376B, para 1 of penal code states:

        376B. (1) Any person who obtains for consideration the sexual services of a person, who is under 18 years of age, shall be punished with imprisonment for a term which may extend to 7 years, or with fine, or with both.\"

        CNA reporter is not entirely wrong in saying 'absolute liability' n \"no intent', its a matter of interpretation.
        Maybe wrong choice of words.
        IMHV, \"obtains for consideration\" means dat d prosecution doesn't even hv to prove dat actual penetration takes place (how to in these cases?), just dat d totality of circumstantial evidence - hp, sms, hotel records etc is sufficient proof of intent.
        d accused paid a premium to a call girl n checked into a hotel room to talk about a day in d zoo? cheezzz.

        d more interesting point to me is d statement dat SC Nehal Singh made n is asking for clarification fr court
        - d wide range of possible sentencing when charged under dis provision ranging fr a fine to jail to fine+jail.
        Following so close in d tail of WW's $1000 fine, it will be interesting to watch wat will transpire for Howard Shaw.

            thing is PC Principal had served jail for 4 weeks. He had set the precedent.
            for Shaw & that Swiss angmo from Investment banking industry, do you think they can escape jail term ?

            If not, next qn is … will their jail term be longer or shorter than P’s 4 weeks ?

              but if he end up squat inside Changi prison cell, he can watch lots of Shaw movies with his in-mates everyday, free of charge.

              perhaps someone can film a movie for him at Changi prison: starring him.

              Not fair right ? He should spend 9 weeks in Changi too. Squat inside the cell but don't tell people his name is Shaw.

                      he better don't disclose his surname, if he squat in Changi.
                      his prison cell mates will laugh at him \"Why so careless, boarding tour bus #17 ? \", if they find out his identity. Everyday when they're free chitchatting, they'll discuss hot topic, about \"That Man Who Stray - Just After Saying I Do!\"

                      however since he's so rich, don't know whether Changi got special comfortable designated prison cells .... meant for the rich. Maybe got golden tap to wash hands, like TT Durai.

                        Rich men think they have plenty of dough and is in control of everything.
                        It's precisely when rich men misbehave, they put themselves in limelight for wrong reasons. People will take notice. Something fresh and interesting.
                        Married for just 7 months. Btw, I thought men in Shaw family are good looking :scratchhead: this particular one in the news is not leh.
