        first case- is obviously one of abuse. Physical as well as emotional, what more to a vulnerable 5 year old.


        second case- The teacher may have the interest of the kid at heart, though her handling is questionable. I have to qualify here that it’s "may" coz we do not have the full details regarding the case. But at least no physical harm is done…

                    1) difference in maturity of the child involved. Kindy kid may not fully understand rules whereas the other child is a 12 year old who should have a better appreciation of school rules. Just like why we have a juvenile court for the younger criminals


                    2) severity of the punishment (the kindy teacher not only made her stand naked but also physically injured her – hit her head against the white board. In the other case, the kid did not come to any physical injuries.
