      Can but you need to consider the following before transfer:
      1) Do you have cash to return the CPF used by your spouse (if any) for the current 2nd property?
      2) Do you have cash to pay the 7% absd and 3% bsd on 50% of the valuation of your current 2nd property? IRAS requires this before transfer by gift is allowed.
      3) If your current 2nd property was bought less than 5 yrs ago, do you have cash to pay the seller's stamp duty on 50% of the valuation?
      4) After using cash to pay off those things mentioned above, do you still have enough cash to buy your new \"2nd\" property (actually the 3rd)?
      5) Also, dun forget the legal implications if the marriage sours so must think through carefully...

      Very lucky to have the lax rulings on HDB rental and ownership... private property owners can't even buy a HDB... :pokeeye: šŸ˜‚

      Thanks cherrygal for the providing me with the implications. After doing my sums, I think it would be better to consider purchasing as \"3rd\" property. Bought the HDB some 20 years ago while 2nd property was bought abt 10 years ago. Rental income has helped paid up much of 2nd property as it was only half the price then.

      I am not sure but don't think they quite care how this private property came about in one's possession. Can always try to appeal but I doubt will succeed.
