(1) is usually used to describe teaching methodology, flow of lessons, no? Contextual clues in preceding sentences: freely, leeway -

Why? Because \"provided that\" (though \"conditional\" in nature) doesn't quite trigger the SUBJUNCTIVE MOOD. Use the INDICATIVE MOOD, which takes the 's', as Piggylala has suggested.

Both are fine. 'Unless' has the meaning of 'if...not'.
