there was an article in today's papers giving HIS version. something about the maid being depressed and using the knife to slash herself, forced him to have intercourse with her, and even forced him to open the water tank. Thereafter supposedly she put her head in the water.

it sounds very fantastical. I'm not sure what to believe.

Any right minded person will find this ridiculous. They would have asked questions like:
Let me put myself in his shoes n attempt to answer ur questions:
      Why don't you stop her?
      I was also horny.
You are a man, surely you can overpower her and grab the knife?
      We were into into S&M
      You can seek help?
      We needed d privacy.
Why are you there in the first place?
      We were horny.
There are many chances to stop her, why didn't you?
      I'm a gentleman. d lady insists.
It wasn't that she threatened to jump from the building, when she climbed into the tank, he could have grabbed her etc.
Definitely doubtful testimony but when there's no concrete evidence even you know that's the man right in front of you also cannot do anything. Surprisingly that prosecution didn't raise such questions which should easily overturn his testimony. Maybe his defense lawyer better than the prosecution. This could be the case as it's battle between the wits. :siam:

      Ridiculous enuf? :rotflmao:

As outraged as we are here, I think we really MUST let the law work its course. If there were enough to convict, undoubtedly, the court would have done so. The burden of proof in a homicide is on the prosecution, and just perhaps, in this case, there was not enough to clear that bar.

Yes, no matter how ridiculous his defense might be, we must bear this in mind. In any criminal proceeding, the prosecution has the tougher job as they need to prove the case beyond reasonable doubt but for defense, they just need to raise a doubt.

To us, the accused person’s defense sounds laughable. However, if the prosecution do not have any concrete evidence to prove that he is lying, the judge will have no other choice but to discharge him and correctly in this case, not amounting to acquittal.

An innocent life is already lost. We cannot afford to cause the death of another unless we are 90-100% certain that he did it. He is facing a death penalty, not a fine.

time spent in jail wrongly cannot be restituted

death sentence wrongly meted out cannot be reversed if the 'convict' has been hung

fine wrongly fined - any refund plus interest ?

I think some compensation can be made if one is wrongly sentenced to jail. I remember there was a case involving two brothers, whereby one subsequently was acquitted after serving some time in jail. IIRC, the state offered some compensation.

For fine, so far never heard of anyone who is wrongly fined.

Yes, like what you say, death penalty is one that is non-reversible and thus, need to be more prudent. It is thus not surprising that all cases punishable by death, have to be trial in HIgh Court and if I am not wrong, even the accused person wants to plead guilty to a murder charge, he cannot do so.

Prosecution still have to provide the evidence to prove beyond reasonable doubt that the person is indeed the murderer. So meaning, if there is no other evidence, apart from the accused admitting to it, likely he will be discharged not amounting to acquittal too.

                  Stand corrected on the above.
